What is the T&T Rewards Program?

The T&T rewards program (the “T&T Rewards Program”) is a rewards program offered by T&T Supermarket US Inc. (“T&T,” “our,” “we” and “us”) under these terms and conditions (“Terms and Conditions”).

Program Availability

You can collect T&T rewards points (“Points”) on eligible purchases at all T&T stores in the United States (hereafter collectively referred to as the “T&T Store(s)”) and online at https://www.tntsupermarket.us for redemption of certain rewards. for redemption of certain rewards. How to Join

You can join the T&T Rewards Program by registering for an account (the “Account”) either: (a) online at https://www.tntsupermarket.us/customer/quick/create/ or on the T&T mobile app related to T&T Stores (the “T&T Mobile App”) available for download on your mobile application store, to receive an electronic T&T Rewards Card (an “Electronic Card”), or (b) by completing and submitting the paper application form provided at T&T Stores to receive a set of physical T&T Rewards Cards (a “Physical Card” and each, with Electronic Cards, the “T&T Rewards Card”) instantly. Membership is free, and you do not need to buy anything to open an Account.

Each registered Account includes: (a) if you registered online or through the T&T Mobile App one (1) primary Account and two (2) associate Accounts for you and two (2) other designated individuals; or (b) if registered at a T&T Store or by paper application form in T&T Stores, one (1) main T&T Rewards Card and two (2) mini T&T Rewards Cards, which may be shared with up to two (2) other individuals (each individual sharing the Account, a “Shared Member”). All Points earned, whether in-store through the T&T Rewards Card and mini-T&T Rewards Cards or online, will be applied to the same Account. Each Shared Member of the Account agrees that the other members of the Account can utilize the Points on the Account. The individual registered for the Account is responsible for compliance with these Terms and Conditions by each Shared Member. T&T is not responsible for the misuse of Points by Shared Members of the Account or by the misuse of the T&T Reward Card.

We may change the methods for participating in the T&T Rewards Program from time to time, in our sole discretion. These Terms and Conditions replace any other terms and conditions that we may have provided to you and govern your participation as a member in the T&T Rewards Program. By registering for an Account, you (or your parent or legal guardian on your behalf, as the case may be), accept and agree to be bound by these Terms and Conditions, as may be amended from time to time. Please be sure to check back regularly to ensure you familiarize yourself with the then-current Terms and Conditions, including any changes.

Membership Requirements

To be a member of the T&T Rewards Program, you must be a United States resident and aged eighteen (18) years or older. However, children ages sixteen (16) and seventeen (17) may create an Account, provided that you represent that you: (a) are at least 16 years old; and (b) have read, understood and agreed to these Terms and Conditions. If you are under the age of majority in the state in which you reside, you represent that you have obtained permission from your parent or legal guardian to create an Account. We will collect personal information of all Account holders, including children ages sixteen (16) and above pursuant to our Privacy Policy. T&T Rewards Program membership is not available to corporations, businesses, charities, partnerships, enterprises or anyone other than an individual, unless written approval is received in advance from T&T in its sole discretion.

You must ensure that you keep your personal information associated with the T&T Rewards Card updated or notify us of any changes at any time by contacting our Customer Service Counter at T&T Stores or updating information through the T&T Mobile App. If you do not keep this information up-to-date, you may not be able to receive relevant notices from us regarding the T&T Rewards Program. We are not responsible if we cannot contact you because you have not given us current, accurate information.

How to Earn Points

In any one transaction, Points may only be earned on a single T&T Rewards Card and may only be credited to a single Account.

To earn Points for purchases at T&T Stores, you must provide your T&T Rewards Card number at the time of purchase by presenting the physical T&T Rewards Card, the mini-T&T Rewards Card, or your T&T Mobile App. No Points will be earned once the transaction is completed and T&T will not give any Points based on receipts of past purchases. Photographs, photocopies, or third-party applications showing the barcode of the T&T Rewards Card or the T&T Rewards Card number will not be accepted. Purchases made through your T&T Mobile App automatically earn Points for the associated Account.

Each T&T Rewards Card will accumulate its own balance of Points, and Points cannot be transferred from one T&T Rewards Card or Account to another T&T Rewards Card or Account.

Each Account may only have one (1) Electronic Card linked to it. Additionally, a Physical Card may be registered to the T&T Mobile App or T&T website to use the Physical Card in an electronic format. However, please be aware that the T&T Mobile App will only store and display one T&T Rewards Card at any given time. This means that a T&T Mobile App with an Electronic Card already linked to it may register a Physical Card in electronic format to the same Account, but the original Electronic Card will no longer be displayed within the T&T Mobile App. Points accumulated on the original Electronic Card will be valid and redeemable until termination or expiration as specified herein. The original Electronic Card will be displayed within the T&T Mobile App when the Physical Card is unlinked from the Account within the T&T Mobile App or T&T website.

Every eligible purchase of $20 or more (before tax and after any applicable discounts, coupons, or other deductions) can earn Points. Tips and delivery fees, including, but not limited to, shipping and handling, and service fees do not count toward the calculation of eligible purchases.  Points will be awarded in increments of twenty (20) Points for every $20 (rounded down to the nearest $20 increment) spent on eligible purchases at T&T Stores, T&T Mobile App or online at https://www.tntsupermarket.us/. For example, where $38 is spent on an eligible purchase, you will receive 20 Points; where $75 is spent on an eligible purchase, you will receive 60 Points. All references to dollars or “$” are in United States dollars.

Eligible purchases are defined as the net purchase amount, excluding prescription items, purchase of gift cards, tickets, stamps, lotteries, telephone cards, tobacco, wholesale sales, applicable sales or any other taxes, deposits, eco-fees, coupon discounts, any other products or services that may not be legally offered in connection with the T&T Rewards Program, and any other products or services that we may specify from time to time or where prohibited by law. Points will be earned on purchases using T&T gift cards at the time the T&T gift card is redeemed.

Points earned may take up to twenty-four (24) hours after your purchase to be reflected in your Account.

You can check your Point balance from the purchase receipt or on the T&T Mobile App. To the maximum extent permitted by law, we are not liable for any errors in the Points balance displayed.

Our records of the number of Points earned, redeemed or deducted are deemed accurate. If you have a concern regarding your Account balance, you must contact us and provide relevant evidence within forty-five (45) days from the relevant transaction date to report any discrepancy. If we do not hear from you within forty-five (45) days, it means you agree with us about those Points and you waive any claims with respect thereto.

How to Redeem Your Rewards

Once your Point balance reaches the number of specified Points for redeeming a particular reward, you may redeem items by presenting your T&T Rewards Card at a T&T Store or online at https://www.tntsupermarket.us/, subject to any terms and conditions in effect at the time of redemption.

Points have no cash value and are not exchangeable or redeemable for cash. Points cannot be assigned, exchanged, purchased or given by gift. Points cannot be sold, traded, bartered, rented, leased, licensed or otherwise disposed of. Points are void if sold for cash or any other consideration.

Please refer to in-store or online announcements or the T&T Mobile App for selection of redemption items. In-store redemption items may differ from online and T&T Mobile App items. All redemption items, whether in-store or online, are subject to availability. We do not offer internal transfers, reservations or “rain checks”.

We offer exchanges on reward items with defects at T&T’s sole discretion, but no refunds. The original receipt issued at the time of redeeming the reward item is required, and exchanges are subject to item availability. Exchange of general groceries other than perishable items will be accepted within fourteen (14) days of redemption. Exchange of perishable items will only be accepted within forty-eight (48) hours of redemption and are subject to item availability. Special terms and conditions may apply on reward items, which may be found online or at a T&T Store.

We accept no responsibility for any redemption on your Account, including, but not limited to, redemptions made on your Account while your T&T Rewards Card was lost or stolen, and redemptions made on your Account as a result of unauthorized access to your Account, such as due to a failure to safeguard your password.

If You Need to Return a Purchased Product

On products returned for refund, any Points earned for the original purchase will be deducted from the Account balance if the return results in a reduction of the original purchase subtotal below the threshold amounts for earning Points. For example, (a) if an Account earned 20 Points for an eligible purchase subtotal of $25, but returned product reduced the original purchase subtotal to $18, 20 Points will be deducted from the Account balance, and (b) if an Account earned 20 Points for an eligible purchase subtotal of $30 and returned product reduced the original purchase subtotal to $25, no Points will be deducted, because the resulting purchase subtotal remains above the $20 threshold to earn Points. For the avoidance of doubt, products redeemed using Points are not eligible to return for a refund, but are eligible for exchange subject to the exchange policy above.

If no Points are currently available in the Account balance, and product is returned, your Account balance may become negative.

If You Need a Replacement Card

If your T&T Rewards Card is lost, stolen or damaged, please fill out the Special Request Form and return it to the Customer Service Counter at your local T&T Store. Your name, phone number and other identification documents are required to be verified upon your Special Request Form submission. The new replacement T&T Rewards Cards will be available for pick up within seven (7) days at the same T&T Store location.

The old T&T Rewards Cards will be deactivated, and your Points balance will be transferred to the new replacement T&T Rewards Card based on the latest system record. You understand and agree that T&T is not responsible for any Points lost due to the loss of the T&T Rewards Card or in connection with the transfer of Points to the replacement T&T Rewards Card.

Expiration, Cancellation and Closing Your Account

All Points will expire if your Account is inactive (i.e. no Points collection at a purchase or no redemption) for a continuous period of twelve (12) months.

Failure to meet or observe any of these Terms and Conditions, or intentional misuse of this T&T Rewards Program, may result in membership termination with immediate effect at the sole discretion of T&T.

Misuse of the T&T Rewards Program includes, but is not limited to, at our sole and absolute discretion, any excessive and unnecessary returns or refunds of purchases. T&T reserves the right to cancel or remove Points that have been issued to a member’s Account by mistake or due to a system or human error. T&T will not tolerate your or a Shared Member’s misuse of the system when/if an error in the number of Points occurs, and such misuse can lead to termination of the member’s Account and prohibition from future use, at T&T’s sole and absolute discretion.

In the event of membership termination, no compensation will be offered to you for Points earned but not redeemed. All accumulated Points in your Account will be forfeited and removed from your Account.

T&T reserves the right to cancel, restrict, suspend, substantially modify or otherwise change the T&T Rewards Program or these Terms and Conditions at any time. On such occasion, such changes to the T&T Rewards Program or these Terms and Conditions will be posted at T&T Stores and on https://www.tntsupermarket.us/. If you do not exercise your right to rescind or cancel your participation in the T&T Rewards Program by sending us notice no later than thirty (30) days before the effective date of the change(s), your continued participation in the T&T Rewards Program at any time after such thirty (30) day period has expired will constitute your consent to be bound by the amendment.

You may close or terminate your Account at any time by providing T&T with written notice at the contact information provided below. Only the registered primary T&T Rewards Card holder can close or terminate the Account. Should you close your Account, you will have forty-five (45) days to redeem any Points accumulated in your Account. Any Points not redeemed after forty-five (45) days from the closure of your Account will be forfeited and removed from your Account. Upon the death of a registered primary T&T Rewards Program member, the member’s Account will be closed, and any Points in the Account will be forfeited.

Privacy Policy

The T&T Rewards Program is subject to the Privacy Policy located at https://www.tntsupermarket.us/eng/privacy-policy, as amended from time to time in our sole discretion. By agreeing to these Terms and Conditions, you are also agreeing to the terms of the Privacy Policy, and you undertake to review those terms. Verification of Identity

We may require you to provide us with identification or other form of documentation verifying your identity in a manner acceptable to us when: (a) you redeem Points; (b) T&T replaces your lost, stolen or damaged T&T Rewards Card; (c) T&T grants a requested adjustment of Points (granted in T&T’s sole and absolute discretion); (d) you request T&T to provide any information with respect to your Account; (e) you change information on your Account; or (f) T&T may otherwise require in T&T’s sole and absolute discretion.

General

If there is any inconsistency or conflict between the English and/or Chinese versions of these Terms and Conditions, the English version shall prevail.

Unauthorized reproduction of any T&T Rewards Card is prohibited and can result in legal prosecution. All T&T Rewards Cards belong to us and may be revoked at any time in our sole and absolute discretion.

You are responsible for protecting your Account and T&T Rewards Cards on your Account and any password or security questions used in connection with your Account and T&T Rewards Cards.

We reserve the right to terminate the T&T Rewards Program, or any part of it, at any time on prior written notice. If the T&T Rewards Program is terminated, you will have up to forty-five (45) days after the date of our notice to redeem any Points in your Account. After the expiry of the forty-five (45) day period, any Points that have not been redeemed will be forfeited.

We reserve the right to sell or transfer all or part of the T&T Rewards Program to a related company or to a third party, to merge with another entity or to engage in any form of corporate, reorganization or financing transaction, in our sole and absolute discretion. In addition, the manner in which the T&T Rewards Program is provided to you may change. Please refer to our Privacy Policy at https://www.tntsupermarket.us/eng/privacy-policy, for details as to how your personal information would be handled in such cases.

We reserve the right to refuse to allow you, any Shared Member or proposed member on an Account to join the T&T Rewards Program for any reason in our sole and absolute discretion, including for not meeting the eligibility requirements, for having a membership cancelled previously or for misuse of the T&T Rewards Program.

To the extent permitted by law, by participating in the T&T Rewards Program, you (and your parent or legal guardian on your behalf, as the case may be) agree to release and discharge us, our affiliates, Loblaw Companies Limited (“LCL”), each of LCL’s affiliates, any other third party that may from time to time participate in the T&T Rewards Program, and the officers, directors, agents, representatives, successors and assigns, lenders, insurers, and contractors (including attorneys) of each of them, from any loss, liability, claim, demand, damage or expense asserted by any person or entity relating in any way to the T&T Rewards Program, your participation in the T&T Rewards Program or the redemption and use/misuse of any item or reward obtained through the redemption of Points or otherwise in connection with the T&T Rewards Program.

We reserve the right to withdraw or temporarily change or suspend all or part of the T&T Rewards Program in any way in the event of a material error, omission, technical problem, computer virus or bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond our reasonable control that interferes with the proper conduct of any aspect of the T&T Rewards Program as set out in these Terms and Conditions. Any attempt to deliberately damage any website or to undermine the legitimate operation of the T&T Rewards Program in any way (as we may determine in our sole and absolute discretion) could be a violation of criminal or civil laws and should such an attempt be made, we reserve the right to seek remedies and damages to the fullest extent permitted by law.

Our failure to exercise any of our rights, powers or remedies in these Terms and Conditions or at law, or any delay in doing so, does not constitute a waiver or continuing waiver of those rights, powers or remedies. The single or partial exercise of a right, power or remedy by us does not prevent our subsequent exercise or the exercise of any right, power or remedy.

Words in the singular form shall be construed to include the plural and vice versa, unless the context otherwise requires, and the word “including” means “including but not limited to”. Any dollar amounts referenced in connection with the T&T Rewards Program or these Terms and Conditions are referenced in United States dollars.

Each of the provisions contained in these Terms and Conditions is distinct and severable, and a declaration of invalidity or unenforceability of any such provision or part thereof by a court of competent jurisdiction will not affect the validity or enforceability of any other provision of these Terms and Conditions.
